Contract between Creator and Subscriber

1.1. This agreement governs the relationship in each interaction between the Creator (hereinafter: Creator) and the Follower (hereinafter: Follower).

1.2. Adiuvo d.o.o. – the operator of the Online Portal (hereinafter: Operator) is not a party to this contract.

1.3. The agreement is legally binding and applies to every situation involving an Interaction with Creator.

2.1. Within this contract, the following terms have the following meanings:

3.1. A Follower entering into an Interaction with Creator undertakes to make the relevant Follower Payment, including any applicable value added tax.

3.2. By clicking the "subscribe" button, the Participant agrees to initiate a Subscription for a one-month subscription period, which will automatically renew for the stated amount. The Participant expressly consents and authorizes the Operator to process recurring payments after each subscription period expires, unless the Subscription is canceled or the user account is closed before the last day of the current subscription period.

3.3. The Follower acknowledges that in connection with the Subscription, no additional notifications will be received and the Subscription will automatically renew except in the cases listed above.

4.1. As part of the Interaction with Creator, the Creator grants the Follower a License for Access to Uploaded Content, which enables the Follower to access the relevant Uploaded Content. The license does not transfer ownership rights.

4.2. The Interaction with Creator does not transfer to the Follower any other rights related to the Uploaded Content, including the right to reproduce, distribute, make available to the public, or adapt it. This means, among other things, that the Follower may not create copies of the work, distribute the work, enable access to a wider audience, or modify or adapt the work.

4.3. The License for Access to Uploaded Content automatically terminates:

5.1. The Follower acknowledges that the Operator reserves the right to delete or remove Uploaded Content from the Creator's user account. The Creator may also withdraw or delete Uploaded Content at any time, including pay-per-view Uploaded Content.

6.1. Where the Interaction with Creator constitutes a service that obliges the consumer to make a payment, the Follower loses the right of withdrawal once the service has been fully performed. This article does not apply to Subscriptions.

6.2. Where a Subscription constitutes the supply of digital content and the contract obliges the consumer to make a payment, the consumer has no right of withdrawal if performance has begun and the consumer has consented to this.

6.3. In other cases, the consumer has the right to withdraw from the contract within 14 days. The right is exercised by the Follower notifying the Creator of the withdrawal from the contract.

6.4. Withdrawal also has consequences under the Terms of Service of the Online Portal.

7.1. The Creator and the Follower agree that they are at all times bound by the Terms of Service of the Online Portal.

7.2. The Creator is solely responsible for publishing Uploaded Content.

7.3. The Creator warrants that they hold the appropriate rights related to the Uploaded Content so that they can grant the Follower the License for Access to Uploaded Content.

7.4. The Creator undertakes, upon receipt of the Follower Payment, to make available the Relevant Paid Uploaded Content.

7.5. The Follower acknowledges that third parties may assist and collaborate with the Creator in managing the Creator's user account.

7.6. The Follower undertakes to make the Follower Payment required to access the Relevant Paid Uploaded Content.

7.7. The Follower undertakes not to request a refund of a payment made, except where they dispute the Interaction with Creator in good faith.

7.8. The Follower assumes full risk in accessing the Relevant Paid Uploaded Content, except where negligence can be attributed to the Creator.

8.1. The Follower acknowledges the possibility that circumstances may prevent access to Uploaded Content, including the possibility that the Online Portal or parts of it may be unavailable.

9.1. To the extent possible and permissible, the parties undertake to apply Slovenian law for the interpretation of this contract.

9.2. The parties undertake to resolve disputes amicably; if this is not possible, disputes with persons outside the European Union shall be subject to the jurisdiction of the court in Ljubljana.

10.1. This agreement supersedes all prior agreements between the Creator and the Follower.
